To All,
We have some VERY good Bills introduced to reform the annexation laws and NOW is the time to write and call key legislators about these two Bills. They are:
Senate Bill 494 introduced by Senator Larry Shaw
House Bill 645 introduced by Rep's Dollar, Brown Goforth and Steen and now co-sponsored by Blackwood, Blust, Cleveland, McComas Starnes and Stewart. If you don't see your Representative's name on this Bill, call and ask them to add their name as a cosponsor.
Write to your Senator and ask them to co-sponsor and support Senate Bill 494
Write to your Representative and ask them to co-sponsor and support H645
Tell them that these are the only two Bills that go beyond tweaks and fix the problems with the law.
The people have overwhelmingly asked for meaningful oversight of city initiated annexations and feel that the County Commissioners should have oversight. They are closest elected body most familiar with the area and they represent ALL the citizens who are affected, inside and outside of the cities.
We have asked for reform of the issue of services provided by the cities by making it a requirement that the city that wants to annexed must be providing all urban services that are shown to be meaningful and necessary for the area being annexed. Replacing a good septic system is not meaningful or necessary. Landowners should not have to request water and sewer extensions if the city can prove that they can provide this service and it is needed in the area. Contracting with County service providers like the Sheriffs Dept or Volunteer Fire dept's is not meaningful or necessary.
The people want a meaningful voice in the decision to allow cities to initiate an annexation and better ways to make the city accountable for providing the services that they make promises to deliver in exchange for the right to initiate annexation.
These are not unreasonable things to ask for and expect.
Senate Bill 494 and House Bill 645 are the only two Bills that would make all of these changes to the law.
House Bill 645 will go to the Judiciary II Committee if it passes out of the Rules Committee.
The House Judiciary Committee needs to start hearing from you NOW about the horror stories of annexation as it is today and that H645 will end the abuse.

Simply tell the Legislators that S494 and H645 are the only two Bills that provide meaningful oversight, assure meaningful services, and a meaningful for everyone affected by a city initiated annexation. NONE of the other Bills will change the law in a meaningful way.

Senator Boseman's local moratorium for New Hanover County still does not show up as a submitted Bill. Senator Brock's Bill, S148, has not been referred to committee. All but the two most recent House Bills have been assigned to the Rules Committee, historically known as 'the graveyard', but let's see what House Minority Leader Skip Stam does to move these Bills forward.
There are quite a few annexation related Bills that further remove the limitations on satellite annexations. The power to annex satellite islands removed three to five miles from the city limits makes the argument for forced annexation because it promotes orderly growth blatant hypocrisy.

THE
The 2009 Session has begun and Study Commission recommendations have been delivered to the General Assembly. Legislators are assuring anyone who asks that they have been working on transforming those recommendations into actual Bills to be submitted and filed.
In a meeting with Representative Goforth, he stated that the recommendations might result in three Bills. One Bill would introduce a Moratorium on city initiated annexation. Another would introduce the addition of a referendum to the statutes authorizing city initiated annexation, and a third would consolidate the other recommendations from the Study Commission. We can only wait to see what the language of these Bills will be before we can decide if they are something that we can support.
There seems to be agreement among the reform minded legislators that the moratorium and the restoration of a vote have to be filed separately from the rest of the recommended changes or nothing will move forward at all.
Realistically, we know it is going to be a challenge to push the Legislative Leadership to move the moratorium Bill and the Bill restoring the vote forward and brought to an affirming vote. Tony Rand was overheard by some citizens at the last Commission meeting making assurances to city officials in attendance that neither the vote nor the moratorium "would get past his desk". This is a challenge that we should rise to and believe that we can overcome.
THE BILLS

Sen Boseman’s Bill is listed as “held as filed”. During a visit to the General Assembly, in answer to my inquiry about what that means, I was told by the Clerks office that Senator Rand gave instructions to “hold” Senator Boseman’s Bill.

Annexation Referendum

Senator Brock has faithfully filed this Bill every long session since he was elected. The Bill is pretty straight forward and does not devote any language to tweaking or tinkering with the existing language of the current statutes. It simply repeals them and replaces them with language that allows cities to initiate annexations but they must be put to a vote of the affected people. This simplicity puts all negotiations over provision of services, in exchange for becoming part of the city, between the landowners and the city desiring to annex the land. I’ve always liked that simplicity and freedom that allow both parties to strike a deal that suits both. It would solve both the problem of whether the landowners were getting services that are meaningful to them and the issue of a meaningful voice. With this kind of freedom to negotiate, oversight by a third party is probably not necessary. I’m sure the city lobbyists/lawyers would find all kinds of problems with that, but Senator Brock’s Bills have never been given the opportunity to even have a discussion toward fine tuning a compromise. This is Bill that should be given that hearing. If enough legislators would just admit that the current laws are so hopelessly flawed that tweaking them is futile, we could use a Bill like this as the base to start from.

The very first recommendation, which on the
surface seems to address the "meaningful oversight" that the people were
requesting, is to have the Local Government Commission (LGC) review city
initiated annexations.
(Wow, the alarm bells were going off in my mind immediately.) Let's look at the
make-up of the LGC.
The LGC was created to oversee the balance sheets and borrowing of the local
governments. They have done that well. Giving them the task of reviewing
municipal annexations without any guidelines to determine whether the annexation
should be approved will probably be beyond the Commission's ability. In fact, it
is very likely to end up with similar results to what we have already seen when
the LGC was given the task of approving Tax Increment Financing (TIF) projects.
The Roanoke Rapids Randy Parton Theater project was the very first TIF project
that was given the green light by the LGC. That turned out to be a model of
everything that could go wrong with a TIF project.
We need to take a look at just who are the decision making members of the Local
Government Commission.
I'll give that information to you straight and let you decide how this is going
to work out for the two parties involved in a city initiated annexation.

serves as Chairman and selects the Secretary of the Commission, who heads the

approval, sale, and delivery of substantially all North Carolina local
government bonds and notes. A second key function is monitoring certain fiscal
and accounting standards prescribed for units of local government...."

According to comments during the Joint
Commission discussion of the LGC as the oversight body, this recommendation is
supposed to be better than having the County Commissioners act as the third
party in city initiated annexations. Someone claimed that the LGC would be less
biased and more objective in representing the best interests of the affected
property owners. (Who could say that with a straight face?)
The five appointed members on the LGC consists of lawyers, city bureaucrats, and
unabashed associates/members of the North Carolina League of Municipalities
(NCLM).
So the idea of LGC oversight was to address two of the areas of concern:
meaningful oversight and a meaningful voice for the affected property owners.
This recommendation gets an F- on fulfilling those needed reform areas.
After researching the membership of the LGC, I then went through the remaining
recommendations that the commission waded through before voting on whether to
recommend a moratorium or a referendum.

The recommendations from the Joint Commission sheet were cross referenced with
the "20 point recommendations" that the NCLM presented to the Joint Commission
at the December 17th meeting.
Six out of the eleven recommendations that actually passed out of the meeting
for recommendations to the General Assembly were taken from the NCLM
recommendations either unchanged or with slight alteration.
Six out of the eleven are just tweaks to certain areas of the law that will not
significantly change the problems that we have with the laws that has caused the
ongoing discontent since the laws were enacted, came to a head and brought us to
where we are today.
